1. Acceptance of Terms

By downloading, installing, or using the Apsody mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the App.

These Terms apply to all users of Apsody, including users on the free trial and Apsody Premium subscribers.

2. Description of Service

Apsody is an AI-powered mobile application that generates personalized recipes based on ingredients you provide via camera scan or manual input. The App uses Google Gemini AI to process your inputs and generate recipe suggestions including nutritional estimates.

3. Eligibility

You must be at least 13 years old to use Apsody. By using the App, you represent that you meet this requirement. If you are between 13 and 18, you represent that you have obtained parental consent.

4. Account Registration

You may sign in to Apsody using your Google account or Apple ID. You are responsible for maintaining the security of your account. You must notify us immediately at support@apsody.app if you suspect unauthorized access.

We reserve the right to terminate accounts that violate these Terms.

5. Apsody Premium Subscription

5.1 Free Trial
Apsody Premium annual plans include a 7-day free trial for new subscribers. Your payment method will be charged at the end of the trial period unless you cancel before it ends.

5.3 Billing and Renewal
Subscriptions automatically renew at the end of each billing period. You authorize us (via Google Play or the App Store) to charge your payment method for the renewal amount unless you cancel at least 24 hours before the renewal date.

5.4 Cancellation
You may cancel your subscription at any time through Google Play or the App Store subscription management tools. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time within a billing period.

Refund requests are handled in accordance with Google Play and Apple App Store policies. Contact support@apsody.app for assistance.

6. AI-Generated Content

Recipes, nutritional information, and other content generated by Apsody are produced by artificial intelligence (Google Gemini Flash 2.0) and are provided for informational and inspirational purposes only.

Important: AI-generated nutritional information is an estimate and should not be used as a substitute for professional dietary or medical advice. Always use your judgment regarding food safety, allergies, and dietary needs.

Apsody makes no warranty regarding the accuracy, completeness, or safety of AI-generated recipes. You use this content at your own risk.

You agree to use Apsody only for personal, non-commercial purposes and in compliance with applicable laws. You must not:

Apsody and all related content, features, design, and code are the exclusive property of Apsody and are protected by copyright and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal purposes in accordance with these Terms. This license does not include any right to resell, copy, or commercially exploit the App.

9. Privacy

Your use of Apsody is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to our data practices as described in the Privacy Policy.

10. Third-Party Services

Apsody integrates with third-party services including Google (AI and authentication), Apple (authentication), Supabase (database), RevenueCat (subscriptions), and BuildShip (backend). Your use of these services is subject to their respective terms and privacy policies.

11. Disclaimer of Warranties

APSODY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

WE MAKE NO WARRANTY REGARDING THE ACCURACY OF AI-GENERATED RECIPES OR NUTRITIONAL INFORMATION.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APSODY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.

Our total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you paid to us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Apsody, its officers, directors, and employees from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

14. Termination

We may suspend or terminate your access to Apsody at any time, with or without notice, for violation of these Terms or for any other reason at our discretion.

Upon termination, your license to use the App ends. You may request deletion of your account data by contacting support@apsody.app.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, through an in-app notification. Your continued use of the App after changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes will be resolved through good-faith negotiation. If resolution is not possible, disputes will be subject to the jurisdiction of the courts in Lima, Peru.
